Welcome to Xoner Inc.. By accessing or using our services through the mobile application, smart ATMs, website, or other digital channels, you agree to the following Terms and Conditions.
1. Definitions
- “Xoner” refers to Xoner Inc., with its registered office at [legal address].
- “User” means any individual or legal entity that uses the mobile application, smart ATMs, or related services.
- “Services” include: digital wallet, payments, transfers, currency exchange, cash withdrawals and deposits through partner points and smart ATMs.
2. Use of the Platform
- The User must be of legal age and comply with local regulations.
- Registration requires identity verification (KYC).
- The User is responsible for keeping their access credentials confidential.
- The use of the platform for illegal activities such as fraud, money laundering, or terrorist financing is strictly prohibited.
3. Financial Services
- Wallet balances represent electronic money backed by bank accounts or authorized partners.
- Cash withdrawals are subject to fees and daily limits established by Xoner.
- Exchange rates for currency conversions are determined by the system in real time and may vary without prior notice.
4. Smart ATMs (Smart Kiosks)
- ATMs installed by partner companies are part of the Xoner network, but their operation depends on each location’s availability.
- The User may withdraw funds from their wallet or from third-party wallets connected through integration (e.g., Colombianísimas).
- Deposits to bank accounts through ATMs are subject to validation by the receiving institution.
5. Xoner’s Responsibility
- Xoner acts as a technology facilitator and not as a banking institution.
- It is not responsible for failures in the banking network, third-party availability, or force majeure events.
- In case of detected fraud, Xoner may block accounts, freeze funds, and report to competent authorities.
6. Limitation of Liability
- Xoner does not guarantee uninterrupted availability of the platform.
- The User assumes risks associated with internet connections, mobile devices, or third-party ATMs.
- Xoner’s maximum liability towards the User shall not exceed the amount of fees charged in the last 3 months.
7. Data Protection
- Xoner complies with applicable regulations on personal data protection (GDPR / Law 1581 in Colombia / CCPA in the U.S., as applicable).
- Personal information will only be used for service provision, identity verification, and legal compliance.
8. Modifications
- Xoner reserves the right to modify these Terms and Conditions at any time.
- The User will be notified of important changes through the App or by email.
9. Governing Law
- These Terms are governed by the laws of the State of Florida, U.S.A. (Xoner Inc.’s legal headquarters) and, in the case of local operations, also by the financial regulations of each country where the services are provided.
